{"id":8232,"date":"2020-01-09T23:37:21","date_gmt":"2020-01-09T15:37:21","guid":{"rendered":"https:\/\/www.gallhk.com\/applicability-of-the-apology-ordinance-in-the-workplace\/"},"modified":"2022-01-21T14:36:19","modified_gmt":"2022-01-21T06:36:19","slug":"applicability-of-the-apology-ordinance-in-the-workplace","status":"publish","type":"post","link":"https:\/\/www.gallhk.com\/cn\/applicability-of-the-apology-ordinance-in-the-workplace\/","title":{"rendered":"\u52b3\u8d44\u4e8b\u52a1\u7126\u70b9\u52a8\u6001\uff1a\u300a\u9053\u6b49\u6761\u4f8b\u300b\u5728\u5de5\u4f5c\u573a\u6240\u7684\u9002\u7528\u6027"},"content":{"rendered":"\n<p><img loading=\"lazy\" decoding=\"async\" width=\"30\" height=\"38\" class=\"wp-image-6207\" style=\"width: 30px;\" src=\"https:\/\/www.gallhk.com\/wp-content\/uploads\/2016\/12\/icon_pdf.jpg\" alt=\"\"> <a href=\"https:\/\/gallhk.com\/Articles\/Employment_ApplicabilityApologyOrdinanceWorkplaceDec2019_cn.pdf\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">\u4e0b\u8f7d PDF<\/a><\/p>\n\n\n\n<p>\u5927\u5bb6\u8d8a\u6765\u8d8a\u5173\u6ce8\u5de5\u4f5c\u573a\u6240\u4e2d\u51fa\u73b0\u7684\u95ee\u9898\u548c\u6295\u8bc9\u3002\u5e38\u89c1\u95ee\u9898\u53ef\u80fd\u5305\u62ec\u6d89\u53ca\u9a9a\u6270\u3001\u6b3a\u51cc\u3001\u6b67\u89c6\u548c\u7279\u6b8a\u4f18\u5f85\u7684\u6295\u8bc9\u3002\u5f53\u7d27\u5f20\u52a0\u5267\u65f6\uff0c\u9053\u6b49\u901a\u5e38\u6709\u52a9\u4e8e\u6d88\u5f2d\u51b2\u7a81\u548c\u6539\u5584\u5173\u7cfb\u3002\u4f46\u662f\uff0c\u5f88\u591a\u4eba\u901a\u5e38\u4e0d\u613f\u610f\u9053\u6b49\uff0c\u62c5\u5fc3\u6b64\u4e3e\u53ef\u80fd\u6784\u6210\u627f\u8ba4\u8fc7\u5931\uff0c\u800c\u8fd9\u4e00\u70b9\u53ef\u80fd\u5728\u6cd5\u5f8b\u8bc9\u8bbc\u4e2d\u88ab\u5bf9\u65b9\u5229\u7528\u3002<\/p>\n\n\n\n<p>\u9999\u6e2f\u662f\u4e9a\u592a\u5730\u533a\u9996\u4e2a\u9881\u5e03\u4e0e\u9053\u6b49\u76f8\u5173\u6cd5\u89c4\u7684\u53f8\u6cd5\u7ba1\u8f96\u533a\u3002\u300a\u9053\u6b49\u6761\u4f8b\u300b\uff08\u7b2c 631 \u7ae0\uff09\uff08\u7b80\u79f0\u201c\u6761\u4f8b\u201d\uff09\u4e8e 2017 \u5e74 12 \u6708 1 \u65e5\u751f\u6548\uff0c\u76ee\u7684\u662f\u4fc3\u8fdb\u548c\u9f13\u52b1\u9053\u6b49\uff0c\u9632\u6b62\u4e89\u7aef\u5347\u7ea7\uff0c\u5c3d\u91cf\u53cb\u597d\u89e3\u51b3\u3002\u6839\u636e\u8be5\u6761\u4f8b\u7b2c 7 \u6761\uff0c\u6761\u4f8b\u751f\u6548\u540e\u4efb\u4f55\u4eba\u9053\u6b49\u5747\u4e0d\u6784\u6210\u660e\u793a\u6216\u6697\u793a\u5730\u627f\u8ba4\u8fc7\u5931\uff0c\u4e5f\u4e0d\u5f97\u4f5c\u4e3a\u6cd5\u5f8b\u7a0b\u5e8f\u7684\u8bc1\u636e\u8fdb\u884c\u91c7\u7eb3\uff08\u6709\u4e2a\u522b\u4f8b\u5916\uff09\u3002<\/p>\n\n\n\n<p>An apology is defined in the\nOrdinance as an expression of regret, sympathy or benevolence, whether oral,\nwritten or by conduct made by a person or on behalf of a person. It includes an\nexpress or implied admission of fault or liability. The Ordinance protects\napologies made in proceedings, including judicial, arbitral, administrative,\ndisciplinary and regulatory proceedings, but excludes apologies made in criminal\nproceedings and proceedings conducted under the Commissions of Inquiry\nOrdinance (Cap 86), Control of Obscene and Indecent Articles Ordinance (Cap\n390), Coroners Ordinance (Cap 504) and of the Legislative Council. <\/p>\n\n\n\n<p>The Ordinance will therefore\napply to an apology made in respect of claims and proceedings relating to\nemployment disputes brought in the Labour Tribunal and\/or High Court,\ncomplaints made to the Equal Opportunities Commission and claims relating to\ndiscrimination, harassment and\/or victimisation filed in the District Court. <\/p>\n\n\n\n<p>However, it is important to\nnote that there are certain exceptions to the applicability of the Ordinance.\nPerhaps the most relevant is that a decision maker (for example, the court,\ntribunal or arbitrator) may, in an exceptional case, exercise a discretion to\nadmit a statement of fact contained in an apology as evidence in the\nproceedings, where it is just and equitable to do so, having regard to the\npublic interest or the interests of the administration of justice. It is not\nclear how the decision makers will interpret what constitutes an \u201cexceptional\ncase\u201d and how it will exercise its discretion in determining to admit a\nstatement contained in an apology as evidence in proceedings.
